My friend was stopped by the police.
He is the registered keeper of the car, however, his girlfriend who is a provisional licence holder was driving with no insurance, and he was the passenger.
Both of them had been smoking weed.
She was arrested and taken to the police station where they swabbed her and attempted to take blood but couldn't as the blood would not come out.
She has a court hearing for driving with no insurance and drug driving.
He has been given a court hearing for allowing her to drive with no insurance.
Is there any way to get this resolved without them being charged?
As per Black's law dictionary, they were not driving, they were travelling in a private conveyance. It was not a commercial activity.
What is the best way to convey this and any other law that will help to the court/judge?
The court hearing letters have given a date to attend court on the 5th Sep 2024.
I realise my friend has been irresponsible. He has learned from the situation and they have both stopped smoking. I would like to get them through this as they need to be able to drive (travel in his private conveyance) for work and to see his child.
